The Site is owned and operated by Elevation Marketing & Events, doing business as Elevation Marketing™ (“Elevation Marketing,” “we,” “us,” or “our”).

We may, but are not obligated to, review, monitor, or remove User Content at our discretion.

8.1 Third-Party Links. The Site may contain links to third-party websites, applications, or services that are not owned or controlled by Elevation Marketing™ (e.g., scheduling tools, payment processors, social media platforms, analytics tools).

8.2 No Endorsement or Control. We do not endorse, control, or assume responsibility for any third-party sites or services. Your use of such sites is at your own risk and subject to the terms and policies of those third parties.

To the fullest extent permitted by applicable law:

11.1 No Indirect Damages. In no event will Elevation Marketing & Events, Elevation Marketing™, or our owners, employees, contractors, agents, or affiliates be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with:

  • Any content or information obtained from the Site or Services.
  • Any conduct or content of any third party.

11.2 Cap on Direct Damages. Our total aggregate liability for any and all claims arising out of or related to these Terms or your use of the Site or Services shall not exceed one hundred U.S. dollars (US $100) or the amount you paid to us for Services giving rise to the claim in the three (3) months preceding the event, whichever is greater.

11.3 Jurisdictional Limits. Some jurisdictions do not allow limitations of certain damages, so some of the above limitations may not apply to you. In such cases, our liability shall be limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Elevation Marketing & Events dba Elevation Marketing™, and our owners, employees, contractors, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of these Terms.
  • Your violation of any rights of another person or entity.
  • Your User Content or other information you submit or provide through the Site.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, at your expense, and you agree to cooperate with our defense of such claims.

13. Termination

We may, in our sole discretion and without prior notice, suspend or terminate your access to the Site or Services, or any portion thereof, for any reason, including but not limited to:

Upon termination:

14. Governing Law & Dispute Resolution

14.1 Governing Law. These Terms and your use of the Site and Services shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.

14.2 Venue. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or Services shall be brought exclusively in the state or federal courts located in Colorado, and you hereby consent to the personal jurisdiction and venue of such courts.

14.3 Time Limit. Any claim or cause of action you may have arising out of or related to these Terms or the Site must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

15. Miscellaneous

15.1 Entire Agreement. These Terms, together with our Privacy Policy and any other legal notices or additional terms posted on the Site, constitute the entire agreement between you and Elevation Marketing regarding your use of the Site and Services.

15.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

15.3 No Waiver. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

15.4 Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms at any time without notice.

15.5 Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
